What is a speeding offence?
Speeding is an offence under Road Rules 2014 (NSW) and the Road Transport Act 2013 (NSW). You can be penalised for driving faster than the set speed limit, regardless of whether it was intentional.
Serious speeding offences are considered if you:
- Driving more than 45km/h above the speed limit
- Driving more than 30km/h but not more than 45km/h above the speed limit
- Driving with a licence disqualification or suspension and exceeding the speed limit by more than 30km/h

What is a demerit point?
New South Wales has a demerit points system whereby points can be accumulated upon the commission of traffic offences that carry demerit points. All drivers that hold a valid driver or riding licence begin with zero points. Once an offence is committed, you may have demerit points added to your record. Every licence holder has a demerit point limit, and once that limit has been reached you may have your licence suspended or disqualified.
It is important to note that even if you commit an offence in another state or territory in Australia, that offence may still be applied to your licence.
Below is the threshold of points per licence holder:
- Unrestricted (full) licence holders have 13 points
- Professional drivers holders have 14 points
- Provisional P2 licence holders have 7 points
- Provision P1 licence holders have 4 points
- Learner licence holders have 4 points
- Unrestricted (full) licence holders during a good behaviour bond have 2 points
Demerit points are never removed. They are added to your record when driving offences have been committed and:
- A payment for a fine has been made
- An unpaid fine is enforced by Revenue NSW
- The court issues a conviction for the offence
